1. What the site is

The site publishes information about business machines, including specifications drawn from public ENERGY STAR certification data, buying guides, calculators and links to retailers. It is general information for business buyers. It is not legal, tax, financial, safety, engineering or professional advice, and it is not an offer to sell anything. You must be at least 18 to use the site's forms.

2. Accuracy

Specifications are republished as manufacturers certified them, and we cannot verify them. Prices, availability, regulations and standards change. Calculators give estimates from the figures you enter and stated assumptions. Confirm anything that matters with the seller, the manufacturer or a qualified professional before you rely on it. We may correct, change or remove content at any time.

3. Retailers, dealers and installers

Links to Amazon and other retailers are affiliate links, and we may earn a commission; see our disclosures. When you request quotes, we may introduce you to independent dealers or installers who may pay us for the introduction. They are not our employees, agents or partners. We do not sell, supply, install, service, price or warrant their products or work, and any contract you enter into is solely between you and them. Check licensing, insurance, contract terms and references yourself.

4. Your submissions

You agree that what you submit through a form is accurate, is yours to send, and does not include anyone else's personal information without their permission. You give us permission to use it to respond to you and for the purposes described in our privacy policy. Do not send confidential, sensitive or regulated information.

5. Acceptable use

You agree not to:

• submit false, abusive or automated form entries, or other people's contact details;
• interfere with the site, probe its security, or bypass its protections;
• access the site with automated tools at a rate that burdens it (search engines and similar crawlers that respect robots.txt are welcome);
• use the site to break any law or infringe anyone's rights.

6. Intellectual property

The underlying ENERGY STAR data is public information. The site's written guides, selection and arrangement, design, calculators and code are ours or our licensors' and are protected by copyright. You may quote reasonable extracts with a link back. Brand and product names belong to their owners and are used only to identify products; their use implies no endorsement. ENERGY STAR is a registered trademark of the US EPA, and the site is not endorsed by the EPA.

If you believe material on the site infringes your copyright, send a notice identifying the work, the material and where it appears, with your contact details and a good-faith statement, to legal@businessmachines.com.

7. Third-party sites

We link to sites we do not control. We are not responsible for their content, products, services or policies.

8. Disclaimer of warranties

The site and everything on it are provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose, non-infringement and uninterrupted or error-free operation, to the fullest extent the law allows.

9. Limitation of liability

To the fullest extent the law allows, we will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, data or goodwill, arising out of or relating to the site, any content, any product or any dealer or installer, even if told they were possible. Our total liability for any claim relating to the site is limited to one hundred US dollars ($100). Some jurisdictions do not allow these limits, so they may not all apply to you.

10. Indemnity

You agree to defend, indemnify and hold us harmless from claims, losses and costs, including reasonable attorneys' fees, arising from your breach of these terms, your submissions or your misuse of the site.

11. Disputes, arbitration and class action waiver

Please contact us first; most concerns can be resolved informally within 60 days. If not, any dispute arising out of or relating to the site or these terms will be resolved by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may bring an individual claim in small claims court, and either party may seek an injunction for misuse of intellectual property. The arbitrator decides all questions of arbitrability except the scope and enforceability of the class action waiver, which a court decides.

You and we each waive the right to a jury trial and to bring or join any class, collective or representative action. You may opt out of this section within 30 days of first using the site by sending your name and a statement that you opt out to legal@businessmachines.com.

12. Governing law

These terms are governed by the laws of the State of New York and the Federal Arbitration Act, without regard to conflict-of-law rules. Subject to section 11, the state and federal courts in New York County, New York have exclusive jurisdiction.

13. General

We may change these terms by posting a new version with a new date; continued use after that means you accept it. If any part is found unenforceable, the rest stays in effect. Our failure to enforce a term is not a waiver. These terms and the policies they refer to are the whole agreement between you and us about the site.
